1. Introduction
These Terms of Use (“Terms”) govern your use of the Antique Scanner mobile application (“the App”, “we”, “us”, or “our”). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
2. Use of the App
- The App is intended to scan images of antique items and provide information such as historical background, estimated market value, and recommendations for sale.
- You may use the App only for lawful purposes and in accordance with these Terms.
- You agree not to misuse the App, attempt to gain unauthorized access, or interfere with its functionality.
3. User Content
- When you upload or scan images, they are processed by our servers and deleted immediately after analysis.
- You retain ownership of the content you upload but grant us a limited license to process the content for the purpose of providing the service.
- You are responsible for ensuring that the content you upload does not infringe the rights of third parties or violate any laws.
4. Subscriptions and Payments
- Antique Scanner offers premium features via auto-renewable subscriptions managed through Apple App Store.
- All payments, renewals, and cancellations are handled directly by Apple under their terms and policies.
- You can manage or cancel your subscription at any time through your Apple account settings.
- No refunds will be provided by us. Refund requests must be directed to Apple.
5. Intellectual Property
- All rights, title, and interest in the App (including design, features, and content, excluding user-uploaded content) are owned by us.
- You may not copy, modify, distribute, or reverse-engineer any part of the App without our prior written consent.
6. Advertising and Third-Party Services
- The App may display ads from third-party providers (Apple Search Ads, Google Ads, Facebook Ads).
- We also use analytics and subscription management services (Amplitude, RevenueCat).
- Your use of the App constitutes your agreement to data being processed in accordance with our Privacy Policy.
7. Disclaimers
- The App provides antique analysis and estimated valuations for informational purposes only.
- We do not guarantee the accuracy, completeness, or reliability of valuation results or recommendations.
- Any decisions based on the information provided by the App are made at your own risk.
8. Limitation of Liability
- To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the App.
- Our total liability shall not exceed the amount paid by you (if any) for using the App during the 12 months prior to the claim.
9. Termination
We reserve the right to suspend or terminate your access to the App if you violate these Terms or misuse the service.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles.
11. Changes to the Terms
We may update these Terms from time to time. Changes will be posted within the App, and the “Last updated” date will be revised. Continued use of the App after updates constitutes acceptance of the new Terms.
